When you travel overseas, you may be required to submit certain legal documents to the authorities and agencies in your country and the country you intend to visit. In order to apply for a visa, you must provide all the required information.

The government must verify your documents before you enter a foreign country so that they know who you are, why you’re there, and why you’re entering. Authentication stamps confirm the accuracy and genuineness of the information on the documents in addition to the stamp of authenticity. Depending on where you plan to travel, you may need to have your documents attested or apostilled.

Documents needing an Apostille or Attestation include:

  • These include birth certificates, marriage certificates, divorce certificates, passports, and medical certificates.
  • An educational certificate could be a diploma, a degree, a transfer certificate, a high school diploma, or a diploma of graduation from secondary school.
  • A bill of lading, an invoice, a bill of lading, a certificate of origin, an export licence, and incorporation certificates are all certificates relating to commercial transactions.

What is Attestation?

An archive and its marks must be authenticated in order to prove their legitimacy and to prove their authenticity. The Process of Getting This Attestation

Three Types of Attestation

1. Attestation by the state

Prior to MEA validation, state HRD Attestation is required based on the type of record. 

As an example, the State Education Department is responsible for authenticating educational records such as degree, diploma, transcript, grade cards etc.

The State Department of Home Affairs or General Administration Department verified the personal record including Birth certificates, Marriage Certificates, Police Clearance Certificates, and so on before they can be verified by the MEA in cases of individual archives.

2. Attestation from MEA (Ministry of External Affairs) Attestation

Certificate Attestation from the Ministry of External Affairs is very important if you want to get the embassy’s endorsement for a document before you leave for work, business, or school overseas.

What is Apostille?

An apostille is an attestation in which a sticker is pasted at the backside of the document that is recognized by all Hague Convention member countries. Around 92 countries recognize the Apostille as a valid form of verification, and most western nations are aware of it.

Stamps created by the Ministry of External Affairs, Government of India, are square moulded PC stamps glued on the reverse of documents. With the help of this unique verifying proof number, every member state can check the legitimacy of the stamp. After the appropriate state department’s attestation , apostille may take place.

As soon as the apostille is issued, there is NO further embassy legalisation required.

Facts to know to differentiate between ATTESTATION &  APOSTILLE of a document. 

  • The Apostille was obtained by complying with the Hague Convention Treaty ratified in 1961. Referring to the Convention’s protocol, No Further Concerned Embassy Attestation is required if one is travelling to any member country which falls under Hague Convention, 1961. Getting Apostille will be considered as Universal Verification for all member countries. 
  • The process of Apostille includes getting a separate sticker of validation pasted at the backside of the intended documents whereas getting Attestation means obtaining a round stamp of the verifying authority stating that the content of document is found satisfactory and genuine on all grounds and can be used in foreign. 
  • The Apostille process was introduced in the Hague convention to make process documents Attestation easier, however getting Attestation from MEA involves so many consular activities and thus is more complex and reliable as compared to Apostille Attestation
  • Apostille is only acceptable within the member countries of hague convention whereas attestation can be considered anywhere across the world. For Instance, Apostille is not acceptable for countries like Qatar, Kuwait, Saudi Arabia, Egypt as these countries haven’t signed the Hague Convention yet and thus requires a complete attestation process. 
  • Apostilling a document will be valid for a certain time period and can’t be used again while migrating to some other country. On other hand, Obtaining Embassy Attestation on a document is considered to be valid for life long and can be used multiple times to visit the same related country.
